Medipoint is the sole controller of your personal information for the purposes of all applicable privacy and data protection laws. Our affiliates, referral partners, distributors and resellers are not controllers, processors or agencies in respect of your information. Any complaint, request or regulatory inquiry regarding your information must be directed to Medipoint.
This Privacy Policy should be read together with our Terms and Conditions and, where applicable, our Affiliate Agreement.

Where the laws of more than one jurisdiction apply to your information, we will apply the standard that gives you the greater protection.
"Health Information" means information about your physical or mental health, medical conditions, medications, allergies, blood type, healthcare providers, emergency contacts, and any related notes — including, in New Zealand, "health information" as defined in the Health Information Privacy Code 2020 and, in the United States, where applicable, "protected health information" or "sensitive personal information".
"Personal Information" means information about an identified or identifiable individual, including "personal information" under the Privacy Act 2020 (NZ) and the Privacy Act 1988 (Cth), and "personal data" or "personal information" under applicable US state privacy laws and the GDPR.
"Sensitive Personal Information" has the meaning given under the CCPA/CPRA and other US state privacy laws, and includes Health Information.
"Sell" and "Share" have the meanings given under the CCPA/CPRA. We do not Sell or Share your Personal Information.
Scope: Medipoint is a narrow-scope, display-only service. We collect only the information you choose to enter into your profile, plus the minimum operational data required to deliver the Service. We do not source, verify, augment, infer, derive, aggregate, profile or analyse health information about you. The information displayed when your QR code is scanned is the information you provided, unchanged.
When you create a Medipoint account or profile, we may collect:

If you sign up via a referral link or code from an affiliate, we receive the referral code identifying the partner. We do not receive any other Personal Information about you from affiliates. Affiliates do not have access to your account, profile or Health Information.

Health Information is among the most sensitive categories of personal information. We treat it with particular care and in accordance with the Health Information Privacy Code 2020 (NZ) and equivalent protections in other jurisdictions.
Display-only model: Medipoint stores and displays Health Information that you provide. We do not generate, infer, derive, augment, aggregate or analyse Health Information about you. We do not provide medical advice, diagnosis, treatment, risk assessment, or recommendations of any kind.
Your medical profile is intentionally accessible to anyone who scans your Medipoint card's QR code. No password, login or app is required. This is a deliberate design choice — in an emergency, requiring authentication would defeat the purpose of the card. By using the Service you acknowledge and accept this design.
You control what information is included in your profile. You should only include information you are comfortable being seen by anyone who has physical possession of your card.
Medipoint is not a "covered entity" or "business associate" as those terms are defined in the United States Health Insurance Portability and Accountability Act of 1996 ("HIPAA"). Information you provide to Medipoint is not subject to HIPAA. Medipoint does not provide medical care, diagnosis, or treatment. If you are a HIPAA-regulated healthcare provider considering using the Service in connection with your patients, you are responsible for ensuring your use complies with HIPAA, and you should not assume any HIPAA-equivalent protections apply by default.
Your medical information may be displayed in multiple languages to assist healthcare providers. Translations are performed via a third-party translation service (see Section 6) and are provided as an aid only. Medipoint does not warrant the accuracy of translated medical terminology. The original-language version controls.
We do not sell, rent, or trade your Personal Information or Health Information to third parties. We share information only in the following limited circumstances:
We will never share your Health Information with insurers, employers, marketers, advertisers, AI/ML training providers, or any other commercial third party.
Your Personal Information and Health Information are hosted on commercial cloud infrastructure. Medipoint will, on request to admin@medipoint.co.nz, confirm in writing the name of the current hosting provider and the country in which your data is stored. We transfer your information to other jurisdictions only as necessary to provide the Service, including for payment processing and translation as described in Section 6.

Under the Privacy Act 2020 and the Health Information Privacy Code 2020, you have the rights set out in the Information Privacy Principles, including the right to access (IPP 6) and correct (IPP 7) your Personal Information. We will respond to access and correction requests within 20 working days.
Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to access (APP 12) and correct (APP 13) your Personal Information, and to make a privacy complaint. We will respond to access and correction requests within 30 days.

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Florida, Delaware, New Jersey, New Hampshire, Kentucky, Minnesota, Maryland, Rhode Island, and other states with comparable privacy laws have substantially similar rights to access, correct, delete, and obtain a portable copy of their Personal Information, and to opt out of targeted advertising, sale of personal data, and certain profiling. If we deny your request to exercise a right under a US state privacy law, you may appeal that decision by replying to our denial or contacting us at admin@medipoint.co.nz. We will respond to your appeal within 60 days (or such other period required by your state's law). If we deny your appeal, you may contact your state Attorney General to submit a complaint.
California residents and residents of other states that permit it may designate an authorised agent to make privacy requests on their behalf. We require written authorisation signed by you and proof of identity for both you and the agent.
Our website does not currently respond to "Do Not Track" browser signals because no consistent industry standard exists. Where required by applicable US state law, we treat the Global Privacy Control ("GPC") signal as a valid request to opt out of Sale or Sharing of Personal Information.
